Welcome to Martin Ras Photography. These Terms and Conditions govern your use of our website and the purchase of any products (including prints) or services (including group workshops and 1:1 private workshops).

By accessing this website and purchasing our products or services, you agree to be bound by the following Terms and Conditions.

2. Intellectual Property & Copyright

All content on this website, including photographs, text, graphics, logos, and images, is the exclusive property of Martin Ras Photography and is protected by South African and international copyright laws.

Prints: Purchasing a fine art print does not transfer copyright to the buyer. Prints are for personal display only and may not be scanned, copied, reproduced, published, or used for commercial purposes without prior written permission.

3. Photography Workshops & 1:1 Classes

Martin Ras Photography offers tickets for group workshops and bookings for 1:1 private photography classes.

By purchasing a ticket or booking a private class, you agree to the following terms:

No Refunds: All payments for workshops and 1:1 classes are strictly non-refundable.
Ticket Transfers: If you are unable to attend, you may transfer your ticket or booking spot to another person at no additional charge. You must notify us via email at martin@martinrasphotography.com prior to the start of the class with the replacement participant's full name and contact details.
Rescheduling for Exceptional Circumstances: Date transfers or rescheduling options are strictly reserved for documented exceptional circumstances, specifically severe illness or a death in the immediate family. In such cases, your booking may be moved to a mutually agreed-upon future date. Refunds will not be issued under any circumstances.
Participant Responsibility: Workshops may involve outdoor activities and exposure to the elements. Participants are entirely responsible for their own physical safety, well-being, and the security of their equipment and personal belongings at all times.

4. Print Purchases & Shipping

Order Fulfillment: All prints are custom-made to order. Please allow standard processing and printing times before shipping.
Shipping: We ship to the address provided at checkout. We are not responsible for delays, damage, or loss caused by third-party courier services.
No Refunds on Prints: Due to the custom nature of printed goods, all print sales are final. If a print arrives damaged due to our printing process, please contact us within 48 hours of delivery with photographic evidence so we can evaluate a replacement.

5. Pricing and Payments

All prices are displayed in South African Rand (ZAR) unless otherwise stated.
We reserve the right to change prices for products and services at any time without prior notice.
Full payment is required at the time of booking or purchasing to secure your spot or order.

6. Limitation of Liability

To the fullest extent permitted by law, The Rich Life Collective Pty Ltd (t/a Martin Ras Photography), its directors, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our website, participation in our workshops, or purchase of our products.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape.
